ALGIERS- President of the Republic, Supreme Commander of the Armed Forces, and Minister of National Defense, Abdelmadjid Tebboune, signed, Sunday, two presidential decrees related to pardon granted in favor of 11896 definitively convicted persons, and those who have succeeded in education and vocational training, according to a statement by the Presidency of the Republic.
The statement indicated: “President Abdelmadjid Tebboune, Supreme Commander of the Armed Forces, Minister of National Defense, today signed two presidential decrees. The first relates to a pardon granted for the benefit of prisoners and non-prisoners who have been definitively convicted, whose sentence or the remainder of their sentence is equal to or less than twelve (12) months.
As for the second decree, it concerns “a pardon granted for the benefit of prisoners who have been definitively convicted and who have succeeded in education and vocational training (intermediate education certificate, baccalaureate, university graduation and professional and vocational training certificate) if the remainder of their sentence is equal to or less than twenty-four (24) months.”
The statement pointed out that “the crimes described as acts of terrorism and sabotage, the crimes of corruption mentioned and punishable under Law 01/06 of February 20, 2006 related to the prevention and control of corruption, currency exchange and capital movements, premeditated murder, parricides and the infanticides, beating, and intentional wounding leading to death or permanent disability and manslaughter, kidnapping and sequestration, detention, indecent act with or without violence against a minor, and rape, are excluded from the draft pardon decree.
The decree also excludes “crimes of kidnapping of persons stipulated and punishable under Law No. 20/15 of December 30, 2020, relating to the prevention and control of crimes of kidnapping of persons, crimes of smuggling and drug trafficking as well as smuggling of migrants, crimes related to neighborhood gangs and the fight against them stipulated and punishable under Order No. 20/ 03 of August 30, 2020″.
In addition, the pardon procedures exclude “crimes related to discrimination and hate speech, crimes of attacks and conspiracies against the authority of the state, its institutions and employees, the integrity and unity of the homeland, crimes of armed gathering and incitement to it, crimes related to insult and assault on health institutions and their employees as clarified by Order No. 20/01 of June 30, 2020, amended and supplemented in the Penal Code.
Finally, it excludes “electoral crimes mentioned in the eighth statement of Ordinance 01/21 of March 10, 2021, containing the law relating to the electoral system.”
Accordingly, “11,896 prisoners benefit from this presidential pardon, in addition to the expected number in the second pardon decree, which remains linked to the results obtained in the baccalaureate exam, which may reach 2,000 prisoners,” according to the same source.
